Recognition Next 2024 – Terms and Conditions
Thank you for registering for Recognition Next 2024 (“Recognition Next”). These Terms and Conditions (“Terms”) are between You and Achievers Solutions Inc. and its affiliates (“Achievers”).
General Terms for All Attendees
These Terms govern your registration for and participation in Recognition Next. All bookings are subject to availability and acceptance by Achievers, which will be confirmed in writing (including by email) after you have registered and requested to book by completing the applicable registration forms, completing all mandatory fields and accepted these Terms and confirming you have read our applicable Privacy Policy. By registering for Recognition Next you agree that you have read and accepted these Terms and agree to be legally bound them. Upon Achievers’ written confirmation to you of its acceptance of your registration for a place on Recognition Next, there will be a legally binding contract between Achievers and you, to which these Terms apply. If you are registering for Recognition Next on behalf of another individual, you agree, represent and warrant that you have made that individual aware of these Terms and that they have accepted the Terms. Achievers reserves the right to refuse to accept any registration in its absolute discretion. Bookings are for your own personal use or that of your business only and may not be re-sold under any circumstances, including but not limited to use as part of any promotion or competition.
Privacy
Achievers takes privacy and the protection of your personal information seriously. All information collected, stored or shared in connection with Recognition Next, including information on how and why we use such information, who we share it with, and your legal rights are contained in our Privacy Policy, which is incorporated by reference to these Terms. The Recognition Next participant list will not be made available to participants. However, your details and profile may be available to other participants if you choose to share such information, post Participant Content online or make use of Digital Systems, as defined below in these Terms. Participants will have access to a list of the speakers.
Recognition Next Conference Participation and Conduct
Recognition Next is an in-person event on June 13, 2024 at Hotel X (Toronto 111 Princes’ Blvd, Toronto, ON M6K 3C3). Further venue details will be provided as part of your registration confirmation. In relation to your participation in Recognition Next, you agree that you shall: a) conduct yourself in a respectful, considerate and orderly manner, and shall not act in any manner which causes offence, annoyance or inconvenience to other Recognition Next participants; b) comply with the instructions of Achievers staff and speakers; c) comply with all applicable laws; d) adhere to all applicable COVID-19 guidelines; e) not engage in any form of harassing, offensive, discriminatory, demeaning or threatening speech or behavior, including (but not limited to) relating to race, gender, gender identity and expression, national origin, religion, disability, marital status, age, sexual orientation, military or veteran status, or other protected category; f) not engage in disruptive speech or behavior or otherwise interfere or other individuals’ participation in the event; g) not use Recognition Next for your own commercial or advertising purposes and not spam fellow attendees; and h) not make your own video or audio recordings of Recognition Next and you will not take photographs or screenshots of Recognition Next, its attendees or speakers without Achievers’ express written permission. Achievers in its sole discretion reserves the right to eject an in-person attendee, without any liability or obligation, if we determine that such individual is behaving in a manner which is disruptive or causing a nuisance or annoyance to Recognition Next or the enjoyment and benefit to any other attendee at Recognition Next, or for your failure to comply with these Terms.

Third Party Terms and Conditions
Your use of the registration portal may be subject to additional third-party supplier terms and conditions. To the fullest extent permissible under applicable law, Achievers’ liability in respect of any claim(s) you may under any third party terms and conditions in respect of the portal will be subject to the limitations and exclusions contained in these Terms, other than where you have entered into a direct contract with that third party supplier in relation to the provision of a product or service, in which case, Achievers shall have no liability whatsoever arising for any claims, losses or damages arising from the provision of that third party product or service as . Achievers has no control over these third-party suppliers in such circumstances.
Participant Content
Recognition Next may include features allowing participants to post questions, comments, messages and other content (including, without limitation, direct messages and any interactions in networking sessions (e.g. ON24 and during live sessions the chat function may be enabled) (together, “Participant Content”). Recognition Next may allow all or some participants to access networking features that enable them to directly contact other participants who have access to the same features. You acknowledge that Achievers cannot control the Participant Content posted by others, so we cannot therefore guarantee the accuracy, integrity or quality of any Participant Content. Some participants may not behave in accordance with these Terms and/or may post Participant Content that is misleading, untrue or offensive. You grant Achievers the right to commercially exploit, publish, re-use, archive, modify and delete your Participant Content in whole or in part as we see fit, without any requirement to pay you for this and with or without attribution to you. This means that you grant us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free license to use any Participant Content you publish in whole or in part in any manner and for any purpose whatsoever and without further obligation to you. You also waive any moral rights that you may have in regard to the Participant Content.
Media Consent and Release
Achievers or its partners may be taking photographs and video throughout Recognition Next. If you do not want to be photographed or recorded during Recognition Next you will need to contact Achievers by e-mailing info@achievers.com and the image of your face will be blurred in any published Material. Otherwise, you acknowledge and agree that Achievers may use your name, title, employer name, photograph, likeness, video recording and voice recording (collectively, the “Material”), and grant a worldwide, non-exclusive, perpetual, irrevocable, royalty-free license for Achievers to use the Materials in association with internal company presentations and external promotional, advertising or other materials, including, but not limited to broadcast, print, and electronic materials, internet websites, social media sites and/or computer networks, without any notice, approval or payment to you. You hereby waive any inspection or approval of any such Material or the use thereof and acknowledge and agree that Achievers may copy, cut, crop, edit, revise, alter, adapt, modify, or otherwise change and use the Material, in whole or in part, and allow others to use or distribute the Material, again without any further approval or consideration by you. You hereby waive irrevocably any and all moral rights (or any analogous rights in any country of the world) in relation to the Material, which may exist now or in the future. You waive any right to any future payment for the use of the Materials. You acknowledge that Achievers retains all right, title and interest in and to Achievers intellectual property rights used in relation to Recognition Next, including Achiever’s name, logos and trademarks. You will not acquire in any way any rights, title or interest to the same by virtue of these Terms.
Changes, Postponement and Cancellation
Whilst our program for Recognition Next is correct at the time of publication, we reserve the right to alter aspects of the event including the content, format, speakers or timing at our sole discretion. All participants will be notified of such changes prior to Recognition Next. If your circumstances change and you can no longer attend Recognition Next, please contact Achievers as soon as possible (and in any event no later than 24 hours before Recognition Next) at the e-mail address outlined below. Achievers may at our discretion allow a substitute to attend Recognition Next in your place (following receipt of your express written intention to transfer your registration to a named individual), or cancel your conference pass. Achievers will not allow for changes after certain dates and cannot offer credits for future events. Cancelling or changing your registration will not automatically cancel your hotel and travel arrangements, if applicable. Individuals are solely responsible for cancelling their own hotel and travel reservations in accordance with the cancellation policies of the hotel and/or travel company. The following refund policy shall apply for any Recognition Next pass cancellations:
- Cancellation on or before Friday May 31, 2024 at 17:00ET
- Cancellation or change after 17:00ET on Friday May 31, 2023
No refund
Achievers may cancel or postpone Recognition Next at any time for any reason including, but not limited to, availability or suitability of speaker, health or safety grounds or for the occurrence of a Force Majeure Event, and will notify you as soon as reasonably practicable of any such postponement or cancellation. You agree that Achievers will not be liable to you for any expenses, damage or loss incurred by you as a result of any cancellation or postponement.
Achievers Digital Systems
Your email address will comprise your ID (“ID”) for logging into any website, app or other tools used to host Recognition Next or otherwise provided to participants of Recognition Next (“Digital Systems”). You are responsible for all use of any Digital Systems made by you (including compliance with any relevant third party terms and conditions) and for preventing unauthorised use of your ID. In particular, you should ensure that your ID is not shared with anyone else. If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID you must notify Achievers immediately by emailing us at the address outlined below.
Limitation of Liability
You acknowledge and agree that views expressed by speakers at or in connection with Recognition Next are their own and we do not accept any responsibility or liability for any advice given or views expressed during or in connection with Recognition Next. Content shared or distributed at or in connection with Recognition Next is intended for general information purposes only and should not be relied upon by you or others to address particular requirements. We and our related companies do not provide any guarantees, conditions or warranties that the content is complete or accurate and do not accept any responsibility or liability for reliance by you or any person on any aspect of Recognition Next and/or any information provided at Recognition Next. Content distributed by or on behalf of Achievers in connection with Recognition Next may not be shared or reproduced without Achiever’s express written permission.
- Subject to provision below 3 below, Achievers shall not be liable to you whether in contract, tort (including for negligence), misrepresentation, restitution or otherwise for any for any loss of profits; loss of sales or business; loss of agreements or contracts; loss of anticipated savings; loss of income; loss of opportunity; loss of or damage to goodwill; loss of use or corruption of software, data or information; and/or similar losses or pure economic loss, or for any indirect or consequential loss, costs, damages, charges or expenses however arising under or in connection with the performance or contemplated performance of the Terms, even if we had been advised of the possibility of same in advance;
- Subject to provision 1 above and 3 below, Achievers’ total aggregate liability under and/or in connection with these Terms, howsoever arising and whether or not foreseeable, in contract, tort (including, without limitation, negligence), misrepresentation, restitution or otherwise, arising under or in connection with the performance or contemplated performance of the Terms is limited to $100 USD.
- Nothing in these Terms will seek to limit or exclude Achiever’s liability: (i) that cannot be excluded or restricted in these Terms in respect of death or personal injury resulting from negligence by operation of applicable law; (ii) for its fraud or fraudulent misrepresentation or fraud or fraudulent misrepresentation by a person for whom it is vicariously liable; (iii) for any matter for which it is not permitted by law to exclude or limit, or to attempt to exclude or limit, its liability, in any relevant jurisdiction (and to the extent any term may otherwise be held invalid as a result of local law not permitting it, in such event, that particular restriction or limitation shall be deemed altered and amended to the extent necessary so that it remains valid).
Indemnity
You shall defend, indemnify, and hold us, our related companies, affiliates, subsidiaries, joint ventures, third-party service providers, and our respective employees, contractors, agents, officers, and directors harmless from all claims, liability, damages, losses, costs and expenses, including legal fees, that arise out of or are related to any breach of the Terms by you or any other liabilities incurred by us arising out of your attendance or participation at Recognition Next.
Force Majeure
Achievers will not be in breach of these Terms or otherwise liable to you for any failure to perform or delay in performing its obligations under these Terms, to the extent that such failure or delay is due to any event or circumstance which is beyond Achiever’s reasonable control, including acts of God, labor disputes or other industrial disturbances, electrical or power outages, utilities or other telecommunication failures, earthquake, storms, or other elements of nature, blockages, embargoes, riots, acts or orders of government, acts of terrorism, or war, or the threat of or actual occurrence of an epidemic or pandemic (“Force Majeure Events”) or the direct or indirect effect of Force Majeure Events.
Miscellaneous
These Terms contain the entire agreement between you and Achievers. If any provision of these Terms is held to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision will be severed and the remainder of the provisions will continue in full force and effect as if the terms had been executed with the invalid, illegal or unenforceable provision omitted. Any express or implied waiver to perform any obligations under these Terms will not prevent the subsequent enforcement of them. To the fullest extent possible, a person who is not a party to these Terms has no right to enforce any term of these Terms (other than where such party is expressly stated to have such right). For the avoidance of doubt, Achievers’ affiliates shall have rights under these Terms and shall enjoy the benefit of these Terms. These Terms will be governed by and construed in accordance with English law. If you reside in North America, you irrevocably submit to the exclusive jurisdiction of the courts of the province of Ontario, Canada. If you outside of North America, you irrevocably submit to the exclusive jurisdiction of the English Courts. Nothing in this clause will limit Achiever’s right to take proceedings against you in any other court of competent jurisdiction.
Changes to these terms
Achievers may update these Terms for legal or regulatory reasons, or to reflect changes in our services or business practices, or changes to Recognition Next. We will provide email notice of any significant changes to these Terms.
